S. 912 — Securing American Agriculture Act

This section directs the Secretary of Agriculture to submit annual assessments to the Senate Committee on Agriculture, Nutrition, and Forestry and the House Committee on Agriculture assessing U.S. dependency on critical agricultural inputs (e.g., agricultural equipment and machinery, fuel, fertilizers, feed and components, veterinary drugs and vaccines, crop protection chemicals, seed, and others as determined by the Secretary) that could be exploited if the People's Republic of China weaponizes such dependencies. The assessments must cover (1) current domestic production capacity and supply chain bottlenecks for each input potentially exploitable by China and (2) recommendations, developed in consultation with the U.S. Trade Representative, Secretary of Commerce, and Commissioner of Food and Drugs, to reduce U.S. dependency through threat mitigation and legislative or regulatory actions promoting onshore or nearshore production. Information collection for the assessments is voluntary from private entities and must be used solely to develop aggregate data that does not identify or allow discernment of information providers; assessments exclude trade secrets or confidential information protected under FOIA exemption 5 U.S.C. §552(b)(4) or criminal disclosure penalties of 18 U.S.C. §1905. (Thus, submitted information receives statutory immunity from disclosure or other uses.)
