This section prohibits each National Laboratory from admitting as a visitor (i.e., seeking or approved for access to premises, information, or technology for less than 30 consecutive days) or assignee (i.e., more than 30 consecutive days), or allowing continued access by, any covered foreign national beginning on the date of enactment. A covered foreign national is a foreign national (i.e., alien under the Immigration and Nationality Act) from the People's Republic of China, Russia, the Islamic Republic of Iran, the Democratic People's Republic of Korea, or the Republic of Cuba, excluding U.S. citizens and lawful permanent residents. It authorizes the Secretary of Energy, in consultation with the Director of the Department of Energy's Office of Intelligence and Counterintelligence and a senior counterintelligence official (i.e., specified FBI positions), to waive the prohibition for an individual via written certification to the National Laboratory that U.S. benefits outweigh national security and economic risks. The Secretary must notify specified Senate and House committees within 30 days of issuing a waiver, including the individual's country of origin, request date, waiver decision date, and reasons.
