S. 957 — Honor Our Living Donors Act

This section prohibits recipients of grants under the living donor assistance program from considering the income of the organ recipient when reimbursing travel, subsistence, and qualifying nonmedical expenses to living organ donors (i.e., the program supports organ donation by covering such costs for donors who might otherwise be unable to afford them). (Thus, reimbursements to donors may not be reduced or denied based on the recipient's financial means.)

This section strikes paragraph (3) of section 377(e) of the Public Health Service Act (42 U.S.C. 274f(e))—which established an expectation of payments by organ recipients—and makes conforming punctuation changes to paragraphs (1) and (2).

This section requires the Secretary, not later than December 31 each year, to prepare, submit to Congress, and make public a report on whether grants under this section—which reimburse travel, subsistence, and incidental nonmedical expenses incurred toward living organ donations (including for up to two companions and in cases of failed donations)—provided adequate funding during the preceding fiscal year to fully reimburse all participating donating individuals for all qualifying expenses. The report must include (1) the estimated number of such individuals who did not receive full reimbursement and (2) the total amount of funding estimated to be necessary for full reimbursement.
