S. 962 — Protecting Children Over Profits Act

This section amends federal surveillance statutes to prohibit reimbursement of providers' costs for assistance in child exploitation investigations, as follows: (1) in 18 U.S.C. 2706(c), designates the existing text as paragraph (1) and adds paragraph (2) exempting from the reimbursement requirement of subsection (a) any records or information relating to child exploitation maintained by electronic communications service or remote computing service providers; (2) in 18 U.S.C. 2518, after the matter following subsection (4)(e), prohibits compensation to such providers for expenses incurred providing information, facilities, or technical assistance relating to child exploitation; and (3) in 18 U.S.C. 3124(c), prohibits such compensation for facilities or technical assistance relating to child exploitation. (Child exploitation, as defined in 34 U.S.C. 21101, includes any conduct, attempted conduct, or conspiracy involving a minor that violates 18 U.S.C. §§1591 (sex trafficking), chapters 109A (sexual abuse), 110 (child pornography), or 117 (transportation for illegal sexual activity) or any criminally chargeable sexual activity involving a minor.)
