S. 984 — Fair Access to Agriculture Disaster Programs Act

This section establishes an exception to the adjusted gross income (AGI) limitation on certain farm payments for a person or legal entity if at least 75% of the entity's average AGI derives from farming, ranching, silviculture, agritourism, direct-to-consumer marketing of agricultural products, sales of agricultural equipment owned by the entity, or other agriculture-related activities, as determined by USDA. The exception applies to payments or benefits under the Agriculture Risk Coverage (ARC) and Price Loss Coverage (PLC) programs (subtitle E of title I of the Agricultural Act of 2014) or the supplemental agricultural disaster assistance program (7 U.S.C. 7333). (As background, ARC and PLC provide revenue and price protection payments, respectively, to producers of covered commodities such as wheat, corn, and soybeans; the disaster program compensates producers for livestock, honeybee, farm-raised fish, and other losses due to weather events and disease.)
