S. 990 — Freedom to Haul Act of 2025

This section prohibits the EPA Administrator from implementing or enforcing the final rule entitled “Greenhouse Gas Emissions Standards for Heavy-Duty Vehicles—Phase 3” (89 Fed. Reg. 29440 (April 22, 2024)). (Thus, the Phase 3 greenhouse gas emissions standards for heavy-duty vehicles—such as trucks and buses—do not take effect.)

This section amends Clean Air Act Section 202(a)(2), which requires EPA emission standards for new motor vehicles and engines to allow sufficient time for technology development and compliance, by redesignating it as subparagraph (A) and adding subparagraph (B) prohibiting any such regulation—including revisions, those prescribed after January 1, 2021, and those proposed after enactment—from mandating specific technology or resulting in limited availability of new motor vehicles based on engine type. It further directs the EPA Administrator to revise existing regulations as necessary to conform to new subparagraph (B) within two years after enactment.
