S.Con.Res. 33 — A concurrent resolution setting forth the congressional budget for the United States Government for fiscal year 2026 and setting forth the appropriate budgetary levels for fiscal years 2027 through 2035.

This section instructs the House Committees on (1) Homeland Security and (2) the Judiciary to submit to the House Budget Committee, not later than May 15, 2026, recommendations for changes in laws within their respective jurisdictions that increase the federal deficit by not more than $70 billion each for the period of fiscal years 2026 through 2035.

This section directs the Senate committees on Homeland Security and Governmental Affairs and the Judiciary to submit to the Senate Committee on the Budget, by May 15, 2026, recommendations for changes in laws within their jurisdiction that increase the deficit by not more than $70 billion over FY2026 through FY2035; upon receipt, the Budget Committee must report a reconciliation bill implementing those recommendations without substantive revision.

This section authorizes the chair of the House Budget Committee to revise committee allocations, aggregates, and other appropriate levels in the budget resolution to accommodate the budgetary effects of reconciliation legislation under section 2001 that complies with the resolution's instructions, with compliance determined by the chair. In the Senate, it similarly authorizes the Budget Committee chairman to revise allocations and aggregates and adjust the PAYGO ledger for compliant reconciliation legislation under section 2002; it further exempts such legislation from short-term and long-term deficit points of order established in prior budget resolutions (specifically, section 404 of S. Con. Res. 13 (111th Congress), as amended, and section 3101 of S. Con. Res. 11 (114th Congress)). (Thus, compliant reconciliation bills receive budgetary space without initially counting against the resolution's targets.)

This section establishes a deficit-neutral reserve fund for legislation reported by the Senate Committees on the Judiciary or Homeland Security and Governmental Affairs—or amendments or conference reports thereon—relating to changes in immigration enforcement and border security policy undertaken by the President following Operation Metro Surge. The Senate Budget Committee chairman may revise committee allocations, aggregates, and other appropriate budget levels and adjust the pay-as-you-go ledger by the amounts provided in such legislation, provided it does not increase the deficit over FY2026 through FY2035.

This section establishes a deficit-neutral reserve fund for legislation funding U.S. Immigration and Customs Enforcement (ICE) personnel to apprehend, mandatorily detain, and expeditiously deport adult illegal aliens convicted of rape, murder, or sexual abuse of a minor after illegal entry into the United States. The Senate Budget Committee Chairman may revise committee allocations, budget aggregates, and the pay-as-you-go ledger for bills, amendments, or conference reports from the Judiciary or Homeland Security and Governmental Affairs Committees relating to such immigration enforcement, by the amounts provided in the legislation, provided it does not increase the deficit over FY2026 through FY2035.

This section directs the chair of the House Budget Committee to submit for publication in the Congressional Record committee allocations consistent with title I—(1) for the Appropriations Committee, for FY2026; and (2) for other committees, for FY2026 and FY2026 through FY2035—if no conference committee is appointed on the FY2026 budget resolution. (These allocations enforce sec. 302 of the Congressional Budget Act of 1974, which authorizes points of order against bills and joint resolutions exceeding a committee's allocation.) It further authorizes the chair of the Senate Budget Committee to submit similar allocations—(1) for the Appropriations Committee, for FY2026; and (2) for other committees, for FY2026, FY2026 through FY2030, and FY2026 through FY2035.

This section requires the budget resolution report, joint explanatory statement, or applicable statement under section 4101 to include discretionary administrative expenses of the Social Security Administration and United States Postal Service in the section 302(a) allocations to the Senate and House Appropriations Committees, notwithstanding specified laws. (Thus, for section 302(f) enforcement in both chambers, estimates of new budget authority and outlays for measures must include these amounts.)

This section establishes procedures for adjustments to allocations, aggregates, and other budgetary levels made pursuant to this concurrent resolution, providing that such adjustments (1) apply while the measure is under consideration, (2) take effect upon enactment, and (3) are published in the Congressional Record as soon as practicable. It further states that revised levels are treated as the resolution's levels for purposes of the Congressional Budget Act of 1974; that relevant budgetary levels are determined by estimates of the chair of the Budget Committee of the applicable House of Congress; and that in the House, consideration of any bill, joint resolution, amendment, or conference report for which the Budget chair makes such adjustments is not subject to the point of order under clause 10 of rule XXI.

This section authorizes (1) the chair of the House Committee on the Budget to adjust the resolution's aggregates, allocations, and other budgetary levels for changes in concepts and definitions consistent with section 251(b)(1) of the Balanced Budget and Emergency Deficit Control Act of 1985; and (2) the Senate Budget Committee chair, upon enactment of a bill or joint resolution providing for such changes, to adjust the resolution's levels and allocations in accordance with section 251(b) of that Act.

This section authorizes the chairs of the House and Senate Committees on the Budget to adjust allocations, aggregates, and other appropriate budgetary levels in this concurrent resolution to reflect Congressional Budget Office updates to its baseline projections for FY2026 through FY2035, including effects of legislation enacted before the resolution's adoption.

This section adopts the provisions of this title as an exercise of the rulemaking powers of the Senate and the House of Representatives, respectively, making them part of each House's rules (superseding other rules only to the extent of any inconsistency) and recognizing each House's constitutional right to change its rules in the same manner as any other rule.

This section makes permanent, for Senate enforcement purposes, subsections (c)(2) and (d)(3) of section 904 of the Congressional Budget Act of 1974—points of order against legislation exceeding specified deficit levels in a budget resolution or violating reconciliation instructions. (Thus, these Senate points of order no longer expire as previously scheduled.)

This section establishes procedures in the House of Representatives for discretionary appropriations provisions designated as emergency requirements, exempting their budgetary effects from being counted for any purpose by the chair of the Committee on the Budget. It excludes proposals to strike such designations from evaluations of budgetary effects and makes in order, at any point during consideration, amendments that reduce amounts appropriated or made available by the measure that are not required by law. The section defines an "emergency" as an unanticipated situation—sudden, urgent, unforeseen, and temporary—requiring new budget authority and outlays for preventing or mitigating loss of life or property or responding to a threat to national security.
