This section proposes an amendment to the Constitution of the United States that, for purposes of the 14th Amendment's citizenship clause, defines a person born in the U.S. as "subject to the jurisdiction thereof" only if at least one parent is (1) a U.S. citizen or national, (2) an alien lawfully admitted for permanent residence whose residence is in the U.S., or (3) an alien with lawful status under the immigration laws performing active service in the Armed Forces. (Thus, children born in the U.S. to two non-citizen, non-permanent-resident parents without qualifying military status—e.g., undocumented immigrants or most temporary visa holders—would not automatically be U.S. citizens.) The amendment authorizes Congress to enforce it through appropriate legislation and becomes valid upon ratification by the legislatures of three-fourths of the states within seven years of submission.
