S.Res. 604 — A resolution recognizing that it is the duty of the Federal Government to develop and implement a Transgender Bill of Rights to protect and codify the rights of transgender and nonbinary people under the law and ensure their access to medical care, shelter, safety, and economic security.

This section expresses the sense of the Senate that the federal government has a duty to protect the rights of transgender and nonbinary people by implementing a Transgender Bill of Rights that includes (1) ensuring equal access to services and public accommodations aligned with gender identity, including by amending the Civil Rights Act of 1964 to prohibit discrimination based on sex, gender identity, or sex characteristics in public accommodations, federally funded programs, and schools (including athletics and facilities); (2) clarifying and reaffirming rights to bodily autonomy and health care, including by eliminating restrictions on gender-affirming care, protecting providers from penalties, banning nonconsensual intersex surgeries and conversion practices, codifying abortion and reproductive rights, and reopening the Sexual & Gender Minority Research Office at the National Institutes of Health; (3) codifying the Supreme Court's Bostock v. Clayton County decision by amending Title VII of the Civil Rights Act of 1964, the Fair Housing Act, and the Equal Credit Opportunity Act to explicitly prohibit discrimination based on gender identity or sex characteristics in employment, housing, and credit; and (4) providing legal recognition of transgender and nonbinary identities, including by simplifying updates to federal identification documents (with self-attestation and X markers where applicable), requiring states to allow same-day voter registration updates, prohibiting discrimination in jury service and immigration based on gender identity, and requiring TRICARE and the Department of Veterans Affairs to cover gender-affirming health care.
