§1. Request for information on Guatemala’s human rights practices
This section requests that the Secretary of State submit to the Senate Committee on Foreign Relations and the House Committee on Foreign Affairs, not later than 30 days after the resolution's adoption and pursuant to section 502B(c) of the Foreign Assistance Act of 1961 (22 U.S.C. 2304(c)), a statement on Guatemala’s human rights practices prepared in collaboration with the Assistant Secretary of State for Democracy, Human Rights, and Labor and the Department of State’s Office of the Legal Adviser. The statement must include (1) all available credible information on alleged violations by the Guatemalan government—including arbitrary detention, torture, due process violations, enforced disappearances, killings, and trafficking, with specific attention to individuals removed to Guatemala by the United States; (2) U.S. government actions to promote human rights observance, discourage violations, assess pre-removal risks to deportees (including potential onward removal and legal status options), and disassociate from abusive practices; and (3) assessments of potential misuse of U.S. security assistance for detainee-related activities, detention conditions, compliance with U.S. court return orders, protections against risks to deportees, relevant agreements or transactions, data on 2025–2026 removals, and facilitation of releases for wrongful removals.
